IAF at the 46th Session of the SCCR

IAF attended the 46th Session of World Intellectual Property Organization’s Standing Committee on Copyright and Related Rights (SCCR) in Geneva, with both in-person and online participation.

IAF submitted statements on several items, such as Exceptions & Limitations, Digital Environment, Public Lending Right, Artists’ Resale Right, and the proposal from Cote D’Ivoire for a Study on the Rights of Audiovisual Authors and their Remuneration for the Exploitation of their Works.

A central focus of SCCR 46 was the revised Draft WIPO Broadcasting Organizations Treaty which aims to provide international protection against unauthorised retransmission and use of broadcast signals. While no consensus was reached, discussions indicated a continued commitment to refining the treaty text. ​

The committee continued to discuss Exceptions and Limitations. IAF submitted a statement arguing against any blanket expansions of copyright exceptions and limitations that disregard the needs of authors. Informal sessions followed the plenary.

Sabine Richly presented an updated version of the Scoping Study on Public Lending Right, with member states welcoming the revised version including the annexes, while some member states argued the need for further discussion on capacity building.

A revised proposal from Cote D’Ivoire for a Study on the Rights of Audiovisual Authors and their Remuneration for the Exploitation of their Works was presented, but member states were unable to reach to a consensus and will be discussed further at the next meeting.

WIPO organised an informative information session on Generative Artificial Intelligence and Copyright, which featured different points of view regarding legislative and not only developments from Member States.

The work plan proposed by the GRULAC group was discussed, urging the need for further engagement due to technological diffusion and AI Developments.

Professor Sam Ricketson presented the updated version of the Artists’ Resale Toolkit, and the request by the delegation of Morocco was brought forward for organising a regional conference to further discuss issues related to Artists’ Resale Rights.

IAF will continue to monitor international developments of interest and will continue working with WIPO on specific issues of common interest.
